Terms and Conditions of Transport
The following conditions are deemed accepted upon the client's approval of the quotation. Arianna Rava, acting solely as a consultant, declines all responsibility for goods and transport. The quotations are valid only if the weights and measurements exactly match those declared on the date of transport. Shipping and airline companies reserve the right to change transport rates at any time; consequently, Arianna Rava reserves the right to charge the client for such changes. Insurance coverage follows ICC A and C conditions, depending on the goods. For more details, please contact us before taking out insurance.
In the event that Arianna Rava advances freight, transport costs, container rentals, duties, expenses or other sums on behalf of the Principal or the Sender, the latter will be responsible for immediate reimbursement, including interest for any delays and losses resulting from exchange rate fluctuations.
The Principal and/or the Sender must hold the Consultant harmless from any payment requests relating to freight, duties, taxes, general average contributions, fines or other sums. Even if such sums are to be paid by the recipient or third parties, the Principal and/or the Sender are still responsible for immediate payment if the recipient does not pay promptly.
Unless otherwise agreed, no amount due to the Consultant may be offset against other sums requested by the Principal or the Sender.
The Principal and/or the Sender are required to reimburse the Consultant for all costs incurred, including those relating to transport vehicle stops, return of goods to the warehouse, storage, and subsequent redelivery.
In case of refusal or unavailability of the recipient, the Consultant, if promptly informed, will take the necessary measures for the safekeeping and return of the goods, acting on behalf of the Principal or the Sender, who remain responsible for any losses, damages, or thefts.
The Consultant is solely responsible for the execution of the mandate received and not for the transport itself. He/she will not be liable for errors, losses, damages, thefts, fires, delays, or non-delivery caused by unforeseen events or circumstances beyond his/her control, including natural disasters, wars, accidents, defects in the goods, or acts of the competent authorities.
If the Principal wishes to insure the goods, he/she may instruct the Consultant to take out a policy. Alternatively, the Principal may independently arrange insurance, ensuring that the policy provides for a waiver of subrogation against the Consultant. The Consultant is not required to handle insurance claims or appraisal activities without a specific assignment and an agreed fee.
In any case, the contractual terms defined at the time of the assignment shall apply.
